ASSET PROTECTION

Everyone Needs Asset Protection, Not Just the Wealthy

Asset protection is a crucial component of a comprehensive estate plan for everyone-- not only individuals with significant assets, business owners, and professionals but also for anyone looking to protect their children from losing everything left to them to predatory creditors and litigators as well as to wasteful youthful indiscretion.

Strategies are available to minimize your risk and make it more difficult for creditors and others to reach what’s important to you. For those (and their advisors) who are concerned about protecting their assets, understanding the importance of safeguarding your assets is fundamental to long-term financial success.

Asset protection is not a one-size-fits-all solution and can often be complex. Building a robust protection strategy requires the guidance of a skilled advisor who takes the time to know you and help tailor strategies suited to your unique situation.

It’s never too early to protect what you’ve worked for. Whether you’re a business owner, investor, or simply concerned about future risks, Viridis Law can help you create a comprehensive legal plan.

FAQ

Asset Protection Frequently Asked Questions

Get answers to our most commonly asked questions.

Can I protect an inheritance I leave to my children?

Yes. Asset protection planning is not limited to protecting your own assets. A properly designed trust can provide continued protection for assets you leave to your children or other beneficiaries even while they benefit. Depending on how the trust is structured and applicable law, this may help protect inherited assets from creditors, lawsuits, poor financial decisions, and claims arising from divorce. Just as importantly, the trust can be designed to give your beneficiaries meaningful access to and control over their inheritance without simply handing them everything outright.

Can asset protection planning protect me from a lawsuit?

Asset protection planning cannot prevent someone from filing a lawsuit, but proper planning can help reduce the assets that may be exposed if a claim occurs.

However, the key is planning before the problem arises. Assets may not be moved to avoid paying for liabilities that already exist. Therefore, once a lawsuit, creditor claim, or other liability is pending or reasonably foreseeable, it’s most likely too late to reorganize your assets, and your planning options may be significantly limited.

Should I put my rental properties in an LLC?

For many real estate investors, holding rental property through one or more LLCs can be an important part of an asset protection strategy. An LLC can help separate liabilities associated with a rental property from an owner's personal assets and, depending on the structure, from other investment properties.

There is no one-size-fits-all structure, however. Financing, insurance, taxes, the number and value of the properties, and the owner's overall estate plan should all be considered before transferring real estate into an LLC.

Can I use both LLCs and trusts for asset protection?

Yes. In fact, some of the strongest asset protection plans use multiple legal tools rather than relying on a single strategy.

An LLC might be used to hold a business or investment property, while a trust may own an interest in the LLC or hold other assets. Insurance can provide another layer of protection. Estate planning documents can then coordinate how those assets are managed during incapacity and ultimately transferred at death. The objective is to create a coordinated structure in which each tool has a specific job.
