Kids Protection Plan

What if you don’t make it home today? Do you have a solid plan to make sure your kids don't find themselves alone, sleeping around strangers? Our Kids Protection Plan gives parents peace of mind that their kids are cared for by someone they trust, not by the wrong relative and not by strangers in the child welfare system.

Keep Your Child's Safety in Your Hands, Even When You Can't Be There

Naming guardians in a will or naming godparents is not enough to prevent the wrong person from caring for your child. A judge may still be able to make seriously important decisions about your child's care if you die or become incapacitated. Without the proper plan, children may find themselves in a strange place, among strange people, without a parent who they have depended on their whole lives for vital support and guidance.

Of course, the child welfare system is full of people who want to do their best for children who have nowhere else to turn, but the system cannot take the place of the people you know and trust. Don't let a judge, who doesn't know you or what matters to you, decide who raises your children or handles the money you’ll leave behind.

Short-Term and Long-Term Guardians

Legally naming guardians keeps your family out of expensive and unnecessary conflict. Appointing short-term guardians will authorize trusted friends or family members to step in immediately during an emergency and naming long-term guardians will ensure your children are raised by who you want.

Prevent Foster Care

A Kids Protection Plan can keep your children out of Child Protective Services while authorities figure out what to do and prevents a stranger or probate judge from choosing who raises your kids.

Medical and Financial Access

Giving temporary caregivers the legal power to make medical decisions and access emergency funds for your children will help make a tragic situation a little less chaotic and stressful.

COMMON ISSUES

Top Mistakes When Naming Guardians

1

Naming a couple to act as guardians.

Have you considered what should happen if the couple broke up or if one of the partners in the couple died?

2

Naming only one guardian.

What if something happens to your chosen guardian?

3

Naming long-term guardians for the long-term but not short-term.

What would happen in those immediate hours until the long-term guardians can arrive?

KIDS PROTECTION PLAN

Protect Your Children in Every Scenario, Not Just the Ones a Will Addresses

Having a will does not ensure the care of your kids if the unthinkable happens. If you are a parent, your estate plan must begin with ensuring your children would always be taken care of by the people you want, that your kids know, love and trust, in the way you want no matter what happens.

At Viridis Law, we have the training and systems in place to plan for your children, whether they are minors or children with special needs who will need care for their lifetime. As a Personal Family Lawyer®, we are uniquely trained to care for the people you love the most.

We talk through your family’s specific situation, explain what the Kids Protection Plan includes, and make sure you have a complete picture of what happens to your children in an emergency.

FAQ

Kids Protection Plan Frequently Asked Questions

Get answers to our most commonly asked questions.

Is naming a guardian in my will enough?

Naming a guardian in your will is an important step, but it is not enough. A will takes effect after death; it does not give a caregiver authority while you are incapacitated, traveling, hospitalized, or otherwise unavailable and it does not plan how your child gets to the guardian. Separate documents in the Kids Protection Plan that meet specific statutory requirements can address those needs and make your guardian preferences easier to locate without requiring someone to locate your will. The goal is a coordinated plan that protects your children both during your lifetime and after your death.

Can grandparents or a babysitter authorize treatment without paperwork?

Being trusted with your child’s care does not necessarily give someone authority to consent to medical treatment, no matter who that may be. Even a close relative may encounter questions about what they are legally permitted to do. Preparing appropriate documents helps the caregiver and medical provider understand who can make decisions and feel comfortable allowing the caregiver to give consent if you cannot be reached.

Do I need these documents for a short trip?

Even a short trip can create a gap between who is caring for your child and who has authority to make decisions. A weekend away, business trip, or vacation may leave you temporarily unreachable. Preparing the appropriate authorization in advance helps your caregiver respond with confidence if your child needs care.

How often should I update my children’s protection plan?

Your plan should be reviewed regularly as your family’s circumstances change, in circumstances like a move, divorce, new child, change in your child’s medical needs, or a guardian’s inability to serve. Temporary authorizations may also expire and require renewal. Keep current copies accessible and make sure the people you have chosen understand their responsibilities.
